Kansas NPDES Information

A Kansas construction stormwater permit is required for any project that disturbs one or more acres of land or is part of a larger common plan of development totaling an acre or more. 

Managed by the Kansas Department of Health and Environment (KDHE), the current Construction General Permit (CGP) remains in effect through July 31, 2027. 

Key Permit Requirements 

• Stormwater Pollution Prevention Plan (SWPPP): You must develop and implement a site-specific SWPPP using best management practices (BMPs) before submitting for permit coverage. 

• Notice of Intent (NOI): Submit your NOI application and supporting documents digitally through the Kansas Environmental Information Management System (KEIMS). Paper forms are no longer accepted. 

• Permit Fee: A $60 application fee applies. 

• Timeline: File your NOI at least 60 days before starting construction activities. Discharge is not authorized until KDHE issues an official authorization number and signature. 

• Project Completion: Submit a Notice of Termination (NOT) once the site achieves final stabilization and construction concludes.
